Terms of Use
Effective July 23, 2026
These terms govern your use of the Dink Data app for iPhone and Apple Watch ("the app"), offered by the developer shown as the seller of record on the App Store listing ("the developer"). By downloading or using the app, you agree to them. Apple's standard Licensed Application End User License Agreement also applies.
License
You get a personal, non-transferable license to use the app on Apple devices you own or control, for your own use. Don't copy, resell, reverse-engineer, or redistribute it.
Free trial and subscription
- The app is free to use for 14 days from first launch. After the trial, continued use requires an active subscription.
- Subscriptions (Monthly, Quarterly, Semi-annually, or Annually) are billed through your Apple Account and auto-renew until cancelled.
- Prices are shown in the app before purchase. You can manage or cancel anytime in your App Store subscription settings; cancellation takes effect at the end of the current billing period.
- Refunds are handled by Apple under App Store policies.
Your data
Match and stat data is stored on your devices and in your personal iCloud account (see the Privacy Policy). You're responsible for your device backups; keeping iCloud enabled is the supported way to preserve data across devices and reinstalls.
Safety and assumption of risk
Pickleball is a physical sport that carries inherent risk of serious injury, including falls and head injuries. The app is a scorekeeping and statistics tool. It does not reduce, manage, or warn about those risks, and it must never take your attention away from active play. Interact with the app only when the ball is dead and you are aware of your surroundings, the court, and other players.
By using the app you acknowledge that you play pickleball at your own risk and that you, not the app or the developer, are responsible for your safety on the court. Dink Data is not a medical or fitness product and provides no health advice. Play within your abilities, and mind the kitchen line.
No warranty
The app is provided "as is", without warranties of any kind. I work hard to make it reliable, but I don't guarantee it will be error-free, uninterrupted, or that a dropped sync will never cost you a stat.
Limitation of liability
To the maximum extent permitted by law, the developer is not liable for indirect, incidental, or consequential damages, or for personal injury or death, arising from use of the app or from playing pickleball. Total liability is limited to the amount you paid for the app in the twelve months before the claim. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
Disputes
If you have a problem, please email support@dinkdata.app first; most issues can be sorted out quickly. You agree to give the developer 30 days to resolve a dispute informally before starting any formal proceeding. These terms are governed by the laws of the State of California, and any dispute that can't be resolved informally will be handled in the state or federal courts located in California.
Apple
These terms are between you and the developer, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it, including product liability, legal compliance, or intellectual property claims. You agree to comply with the App Store Terms of Service when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Severability and entire agreement
If any part of these terms turns out to be unenforceable, the rest still applies. These terms, together with the Apple agreements referenced above and the Privacy Policy, are the entire agreement about the app.
Changes
These terms may be updated as the app evolves; material changes will be posted here with a new effective date. Continued use after a change means you accept the updated terms.
